Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and KAK Digital (Karthik), a sole proprietorship based in India ("PinVari", "we", "us"), covering your use of the PinVari website at pinvari.com, the PinVari macOS application, and related services (together, the "Service"). By downloading, installing, or using PinVari, or by creating an account, you agree to these Terms. If you do not agree, do not use the Service.

1. What PinVari is

PinVari is a macOS application that lets you capture a region of your screen with your voice, resolve the on-screen UI element, transcribe and classify the issue, and route it to an AI coding agent or an issue tracker you connect. Most processing happens locally on your Mac; some optional steps use cloud services as described in our Privacy Policy.

2. Eligibility and accounts

• You must be at least 16 years old and able to form a binding contract to use PinVari.
• You are responsible for the accuracy of the information you provide and for keeping your account and license key secure.
• You are responsible for all activity under your account. Tell us promptly at [email protected] if you believe your account or license key has been compromised.

3. Plans, licenses, and payment

• PinVari is offered on a free plan and paid plans (for example, Pro and Team), as described on our pricing page. Prices and plan features are shown at the time of purchase.
• PinVari Pro and Team are a one-time purchase — a perpetual licence for the version line you buy. There is no recurring or subscription charge.
• Because it is a one-time purchase there is nothing to cancel. Your licence remains valid; see our Refund Policy for the 14-day money-back guarantee.
• Payments are handled by our third-party payment processor. Taxes may be added depending on your location.
• Your PinVari license grants you a personal, non-exclusive, non-transferable, revocable right to install and use the app on Macs you control, for your own or your organization's use, in line with your plan's seat limits.

4. Acceptable use

You agree not to:

• Copy, resell, sublicense, rent, or redistribute the app or your license key except as your plan allows;
• Reverse-engineer, decompile, or attempt to extract source code, except to the extent this restriction is prohibited by law;
• Circumvent license checks, usage limits, or security measures;
• Use PinVari to capture, process, or route content you have no right to access, or in violation of any law or third-party rights (including the privacy of people whose screens or data you capture);
• Use PinVari to build a competing product by copying it, or to harm, overload, or disrupt the Service.

5. Your content and captures

You own everything you capture. Your screenshots, audio, transcripts, and the tokens you enter for your trackers stay on your Mac (see the Privacy Policy). You are solely responsible for what you capture and for anywhere you choose to route it. When you connect a third-party service (Deepgram, OpenRouter, an AI agent, Linear, GitHub, or Slack), your use of that service is also governed by that provider's terms, and you are responsible for having the right to use it.

6. Third-party services

PinVari can interoperate with third-party services and models. We do not control those services and are not responsible for their availability, accuracy, pricing, or how they handle data you send them through your own credentials. Your relationship with those providers is directly with them.

7. Intellectual property

PinVari, including the app, website, brand, and all related software and content, is owned by KAK Digital and protected by intellectual-property laws. These Terms grant you a license to use PinVari, not ownership of it. All rights not expressly granted are reserved. The end-user license terms for the app are set out in our EULA, which forms part of these Terms.

8. Availability and changes

We work to keep PinVari running well, but the Service is provided on an "as available" basis. We may update, change, or discontinue features, and we may update these Terms; for material changes we will update the effective date and notify account holders by email. Continued use after changes means you accept them.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. PinVari classifies and routes issues using automated tools that can be wrong or incomplete; you are responsible for reviewing outputs before relying on them. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, PinVari and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim (or, if you use only the free plan, USD 50). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Indemnity

You agree to indemnify and hold harmless KAK Digital from claims, damages, and costs (including reasonable legal fees) arising from your misuse of the Service, your content or captures, or your breach of these Terms.

12. Termination

You can stop using PinVari and delete the app at any time. We may suspend or terminate your access if you materially breach these Terms or use the Service unlawfully. On termination, your license to use the app ends; the captures on your Mac remain yours to keep or delete.

13. Governing law and disputes

These Terms are governed by the laws of India, and the courts at Coimbatore, Tamil Nadu, India will have jurisdiction over disputes, without limiting any mandatory consumer-protection rights you have where you live.
